1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Elysian Rides (“we,” “us,” or “our”), concerning your access to and use of our services as well as our website. You agree that by accessing the Site and booking our services, you have read, understood, and agreed to be bound by all of these Terms and Conditions.

2. Booking and Reservations

Quotation

All quotations are provided based on the information you supply and are valid for 30 days. Quotations are not a confirmation of booking. A booking is only secured once the deposit and signed service agreement are received.

Deposit and Payment

A non-refundable deposit of 50% of the total service cost is required to secure your booking. The remaining balance is due no later than 14 days prior to the service date. For bookings made within 14 days of the service date, the full payment is required at the time of booking. We accept payment via credit card or bank transfer.

Cancellation Policy

• Cancellations made more than 30 days prior to the service date will result in the forfeiture of the deposit.
• Cancellations made between 14 and 30 days of the service date will be charged 75% of the total service cost.
• Cancellations made within 14 days of the service date will be charged the full 100% of the service cost.
• We understand that unforeseen circumstances can arise. We recommend clients secure appropriate event or travel insurance.

3. Service Provision

Overtime and Delays

The service duration begins at the agreed-upon pickup time and ends at the final drop-off. Any additional, unscheduled time will be billed as overtime in 30-minute increments at our standard hourly rate for the specific vehicle. While we strive to accommodate unforeseen delays, we cannot guarantee availability beyond the scheduled end time due to other commitments.

Vehicle Condition

We guarantee that the vehicle provided will be in pristine, clean, and mechanically sound condition. In the rare event of a mechanical failure or unforeseen circumstance (e.g., accident) making the booked vehicle unavailable, we reserve the right to substitute it with a vehicle of equal or greater value at no additional cost to you. If no suitable replacement can be provided, a full refund will be issued.

4. Client Responsibilities and Conduct

Passenger Conduct

The client is responsible for the conduct of all passengers. The chauffeur has the right to refuse service or terminate a journey if any passenger's conduct is deemed unsafe, illegal, or poses a threat to the chauffeur, the vehicle, or other passengers. Such termination will not result in a refund.

Damage to Vehicles

The client is financially responsible for any damage caused to the vehicle's interior or exterior by any member of their party. This includes, but is not limited to, spills, stains, upholstery tears, and damage from sickness. A cleaning fee (minimum $250) or repair cost will be assessed and charged to the client's credit card on file.

Smoking and Substance Use

Smoking of any kind (including e-cigarettes and vaping) is strictly prohibited in all our vehicles. The consumption of illegal substances is also strictly prohibited and will result in the immediate termination of service without a refund.

Personal Property

We are not responsible for any personal items left behind in our vehicles. We encourage all passengers to check for their belongings before exiting the vehicle. If items are found, we will make a reasonable effort to return them to the client.

5. Limitation of Liability

Elysian Rides shall not be held liable for delays or service interruptions caused by circumstances beyond our control, including but not limited to severe weather, road closures, traffic accidents, or actions by law enforcement. Our liability for any claim, loss, or damage arising out of or in connection with this agreement or the services provided shall be limited to the total amount paid by the client for the service in question.

6. Governing Law

These Terms and Conditions and your use of our services are governed by and construed in accordance with the laws of the state in which our primary business address is located, without regard to its conflict of law principles.
